ServiceThe Trophy mobile application, including match recording, computer-vision (CV) analysis, statistics, highlights, and any connected wearable/health integrations (the “Service”)
Effective date13 October 2026
Last updated13 October 2026
Governing law & disputesUnited Arab Emirates (Emirate of Sharjah); binding arbitration — see Section 17

Please read these Terms carefully before using the Service. They include an arbitration clause and a class-action waiver (Section 17) and limit the Company's liability (Sections 11–12).

1. Acceptance of these Terms

These Terms of Service (“Terms”) form a binding agreement between you (“you,” “User”) and the Company governing your access to and use of the Service. By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Service.

If you are using the Service on behalf of a club, academy, or other organization, you confirm you have authority to bind that organization, and “you” includes that organization.

2. Definitions

3. Eligibility and accounts

3.1 Account holders must be adults

You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, to create an Account and agree to these Terms. The Service is not directed to children, and we do not knowingly allow a Minor to register their own Account.

3.2 Minors appearing in Recordings

Padel is commonly played and watched by families, and a Recording an adult User makes may include a Minor — for example, a parent or coach recording a junior player. An adult User may record and upload a Recording featuring a Minor only where that User is the Minor's parent or legal guardian, or has obtained verifiable consent from the Minor's parent or legal guardian, consistent with Section 5. To reflect the additional sensitivity of Minors' data:

3.3 Account registration

You agree to provide accurate registration information, to keep it current, and to keep your login credentials confidential. You are responsible for all activity that occurs under your Account, whether or not authorized by you, except to the extent caused by the Company's own breach of these Terms.

3.4 Suspension and termination

We may suspend or terminate your Account as described in Section 14.

4. The Service

The Service allows you to record matches, generate CV Output from those Recordings, view statistics and highlights, and optionally connect supported wearable or health-tracking accounts to enrich your profile and in-app insights. Features, supported devices, and integrations may change, be added, or be discontinued, including where required by a Third-Party Platform's policies; where such a change materially reduces functionality you already use, Section 15 applies.

The Service is not a medical, diagnostic, or safety device. CV Output and any fitness-related insights are for general informational and entertainment purposes only and must not be relied on for medical, coaching-certification, or safety-critical decisions. See Section 11 (Disclaimers).

4.1 Plans, hours, and payments

Analyzing a Recording uses hours of analysis, counted by the length of the Recording. An analysis that fails is not counted.

Purchases are made through the Apple App Store or Google Play. Prices are shown in the app before you buy, in the currency and with the taxes your app store applies. The plan renews automatically every month until you cancel it. You can cancel at any time in your App Store or Google Play account settings; cancel at least 24 hours before the end of the current period to avoid being charged for the next one. After cancelling, you keep access until the end of the period already paid.

Payments, refunds, and billing disputes are handled by Apple or Google under their own terms. If a purchase is refunded, the hours or plan access it provided are removed. We may change prices; a new price applies to an active plan only from a renewal after the notice Apple or Google require, and you can cancel before it applies. Nothing in this Section limits a right you have under the UAE Federal Consumer Protection Law or another consumer-protection law that cannot be excluded.

4.2 Who can see your matches

You choose who can see each match: Only me, Participants, Anyone with the link, or Public. A match shared by link can be viewed by anyone who has the link, including on the web without an account, and a Public match is also listed in the in-app Community. Choose a setting that respects the people who appear in the Recording (see Section 5). Our Privacy Policy, Section 6, explains what a shared match shows.

5. Recording other players — consent is between Users

5.1 Your responsibility when you record

Padel and other matches typically involve more than one player, and a Recording you make will usually capture other people — opponents, partners, bystanders, or Minors accompanying other players. By starting a Recording, you represent and warrant that:

  1. you have obtained all consents required by applicable law and by any venue rules from every identifiable person appearing in the Recording (or, for a Minor, from that Minor's parent or legal guardian) for that person to be recorded and for the Recording, CV Output, and any associated data to be processed, stored, and used as described in these Terms and our Privacy Policy;
  2. you have the right to upload, share, and grant the licenses in Section 6 with respect to the Recording; and
  3. your use of the Recording will not violate any other person's privacy, publicity, or other legal rights, or any court or venue, club, or facility rules.

5.2 Consent is a matter between Users, not the Company

The Company is a neutral technology provider. We do not referee, verify, or adjudicate consent between the people appearing in a Recording — that is a matter exclusively between those individuals (whether or not they are Users). The Service may offer in-app tools (for example, a prompt to tag other players or request their acknowledgment before a Recording is saved or shared); use of such a tool is a convenience feature only and does not shift, assign, or create any responsibility on the Company's part for obtaining or verifying consent.

5.3 Release

To the fullest extent permitted by applicable law, you release the Company, its officers, employees, and affiliates from any and all claims, demands, losses, and damages (actual or consequential), of every kind and nature, arising out of or in connection with disputes between Users or between a User and any other person regarding the recording, processing, storage, or sharing of a Recording in which that person appears, including disputes about whether consent was given, withdrawn, or exceeded. Where your jurisdiction requires a specific statement to release unknown or unsuspected claims (such as California Civil Code §1542 or an equivalent law elsewhere), you waive the protection of that law to the extent permitted.

5.4 Removal requests

If someone who appears in a Recording objects to it, they (or the User who recorded it) may contact us at apps@nuawellness.ai. We will review a removal request within 14 days and may remove or restrict a Recording where we consider it appropriate; we are not obligated to proactively monitor Recordings for consent issues.

6. Content license and the Company's commercial rights

6.1 You retain ownership

As between you and the Company, you retain ownership of the Recordings you upload. Granting the license below does not transfer ownership to the Company.

6.2 License you grant to the Company — Recordings and CV Output

You grant the Company a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to host, store, reproduce, adapt, modify, create derivative works from, analyze, publicly display and perform, distribute, and otherwise commercially and non-commercially exploit your Recordings and the CV Output generated from them, in any media now known or later developed, for any purpose, including improving and training the Service's analytics and computer-vision models, product development, marketing and promotional use, research, and other commercial purposes (subject to Section 3.2 for Minors).

What happens when you delete a Recording or your Account: we stop any new use of that Recording and CV Output, and remove it from active product surfaces, within 30 days. This license does not require us to recall or undo: (a) improvements already made to our CV/analytics models using that content before deletion; (b) derivative works or promotional materials already published before your deletion request; or (c) copies retained in routine backups for a limited period, or as needed for legal compliance or to defend a claim. Aggregated Data already generated from your content before deletion is not affected, because it no longer identifies you.

6.3 Aggregated Data

We may freely create, use, license, publish, and commercially exploit Aggregated Data derived from Recordings, CV Output, and Service usage, without restriction and without further consent, since Aggregated Data does not identify you or any other individual.

6.4 Wearable and health data — limited use only

Wearable Data is treated differently from other User Content because of legal and platform-policy restrictions (including Apple's and Google's developer terms). Wearable Data, and any data derived or computed from it, is used only to operate and improve the specific in-app features that depend on it (for example, showing your heart-rate zone alongside a match highlight). We do not sell Wearable Data, do not use it for advertising or interest-based marketing, and do not share it with third parties except service providers who process it on our behalf solely to deliver that feature, or as required by law. This limitation applies to Wearable Data even after it has been aggregated, anonymized, or combined with other data, consistent with the requirements of the platforms through which it is obtained, and is not affected by the broader license in Section 6.2. See our Privacy Policy, Section 5, for the full Limited Use disclosure.

6.5 Body position and appearance in CV analysis

Generating CV Output involves analyzing the body position, movement, and appearance of the people in a Recording, so that the Service can tell the players apart within that Recording and describe how they move and play. We do not use facial recognition and do not use this analysis to identify people across Recordings. See our Privacy Policy, Section 2.3.

7. Acceptable use

You agree not to:

8. Third-party platforms and wearable integrations

Connecting Apple Health, Android Health Connect, a wearable account through the Nua app, or another Third-Party Platform is optional and requires your separate authorization through that platform’s own permission system. Your use of those integrations is also governed by that platform’s terms. We may need to modify, restrict, or discontinue a wearable integration to comply with a Third-Party Platform’s policies; where that removes functionality you already rely on, we will give you reasonable notice where practicable.

9. Company intellectual property

The Service, including its software, CV/analytics models, trademarks (including “Trophy”), and underlying technology, is owned by the Company or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you to use the Service, no rights are granted to you by implication or otherwise.

10. Privacy

Our Privacy Policy explains what information we collect, how we use it, and the choices and rights available to you, and is incorporated into these Terms by reference.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Without limiting the foregoing, we do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) CV Output, statistics, or wearable-derived insights will be accurate, complete, or suitable for any particular purpose including coaching, medical, or safety decisions; or (c) any Recording will be preserved indefinitely or recovered after deletion or data loss.

Nothing in this Section excludes a warranty, right, or remedy that applicable consumer-protection law does not allow us to exclude — including, for a consumer protected by the UAE Federal Consumer Protection Law, your right to compensation for the Company's own breach of these Terms. Where a sentence above would otherwise go further than that law allows, it applies only to the extent that law permits.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) the Company will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, or goodwill, arising out of or relating to the Service, even if advised of the possibility of such damages; and (b) the Company's total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (i) the amount you paid the Company for the Service in the twelve (12) months before the claim arose, or (ii) USD 100.

These limitations apply regardless of the legal theory on which a claim is based (contract, tort, statute, or otherwise) and even if a limited remedy fails of its essential purpose. These limitations do not apply to liability that cannot be excluded or limited under applicable law — for example, liability for death or personal injury caused by the Company's negligence, for fraud or fraudulent misrepresentation, for willful misconduct, or for statutory data-protection obligations owed directly to you as a data subject, to the extent such exclusion is prohibited by the law that applies to you. If you are a consumer protected by the UAE Federal Consumer Protection Law, this Section does not limit a right to compensation that law does not permit us to exclude.

13. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) a Recording you make, upload, or share, including any claim brought by a person appearing in it; (c) your breach of these Terms, including Section 5 or Section 7; or (d) your violation of any law or the rights of a third party.

14. Term, suspension, and termination

These Terms apply from the time you first access the Service until your Account is terminated.

14.1 Termination by you

You may stop using the Service and request Account deletion at any time through the app or by contacting us at apps@nuawellness.ai. Section 6.2 explains what happens to content you have already shared.

14.2 Suspension or termination by us

We may suspend or terminate your Account where: (a) you have breached these Terms; (b) we reasonably believe you have engaged in fraud or unlawful activity; (c) your Account poses a security or safety risk to the Service or other Users; or (d) we are required to do so by a Third-Party Platform or by law. Except under (b), (c), or a legal requirement that prevents us from doing so, we will give you at least 14 days' notice and a reasonable opportunity to address the issue before suspending or terminating your Account.

14.3 Discontinuing the Service

If we discontinue the Service generally (rather than suspending an individual Account), we will give you at least 30 days' notice and a reasonable opportunity to export your Recordings before the Service becomes unavailable, except where continuing to operate the Service would itself violate the law.

14.4 Survival

Sections 3.2, 5.3, 6, 9, 11, 12, 13, and 17 survive termination.

15. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. Where a change is material, we will give you at least 30 days' notice before it takes effect (for example, by in-app notice or email). If you do not agree to a material change, you may close your Account and export your Recordings before the change takes effect, without penalty; continued use of the Service after a material change becomes effective constitutes acceptance of it.

16. Export control and sanctions

You may not use the Service if you are located in, or are a national or resident of, a country or region subject to comprehensive sanctions, or if you are listed on any applicable restricted- or denied-party list, and you agree to comply with all applicable export control and sanctions laws.

17. Governing law and dispute resolution

17.1 Governing law

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Sharjah, without regard to conflict-of-laws principles.

17.2 Arbitration

Any dispute arising out of or relating to these Terms or the Service will be finally resolved by binding arbitration administered by the Dubai International Arbitration Centre (DIAC) under its rules then in effect, by a sole arbitrator, seated in Dubai, United Arab Emirates, and conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.

17.3 Class action waiver

Disputes will be resolved on an individual basis only. Neither you nor the Company may bring a claim as a plaintiff or class member in a class, consolidated, or representative action, to the extent permitted by applicable law.

17.4 Carve-outs

Notwithstanding Sections 17.2 and 17.3: (a) either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information; (b) you may bring a qualifying claim in small claims court instead of arbitration; and (c) nothing in this Section limits a right you hold under the UAE Federal Consumer Protection Law, or another mandatory consumer-protection law that applies to you and cannot be waived by agreement, including a right to bring a claim before a competent government body or court where that law requires it.
